Critical Votes in Pennsylvania on Monday

(September 22, 2018) The Pennsylvania House has announced plans to take two anti-rights bills off the table and bring them to a vote on the House floor this Monday and Tuesday.

Rights supporters in Pennsylvania Must Act NOW!!!

If you live in Pennsylvania, your state representatives need to hear from you TODAY, letting them know that a “Yes” vote on HB 2227 and/or HB 2060 will result in serious repercussions at the polls, particularly for Republicans. If you don’t live in Pennsylvania, your friends in the Keystone State need to see this alert, so forward it to them right now.

The Republican leadership in the Pennsylvania State House is playing right into the hands of the anti-rights Democrats in this case. Republican Speaker Mike Turzai has been duped by a biased media and misleading polls into believing that voters want these bills. He and his colleagues are not looking at the most important political reality:

The only significant voting block driven by gun votes is GunVoters.

Any vote that is perceived by GunVoters to be even the slightest bit in opposition to gun rights, will result in angry GunVoters actively opposing those who voted wrong, and throngs of others will just throw up their hands in disgust and walk away from the backstabbing politicians – costing Republicans votes that they can’t afford in this critical election year.

No Pennsylvania voter is going to switch their vote to Republican based on Republican support for these ill-conceived bills.

No Pennsylvania voter is going to switch their vote to Democrat based on Republicans opposing these bad bills.

The only votes that will be lost or gained based on these bills are the votes of GunVoters, and GunVoters have proven over and over again a willingness to aggressively punish backstabbers at the polls, even if it means a less desirable candidate will win the seat. The politicians need to understand this. If they don’t understand it, then they need you to explain it to them.

HB 2060 and HB 2227 are supposedly intended to keep guns out of the hands of dangerous people, but in reality these bills focus on tools instead of focusing on the dangerous individuals. If someone is suicidal, knocking down their door and taking their guns is not going to make them less suicidal and does not remove their ability to do harm to themselves. In fact, such action is more likely to push them over the edge. Likewise, if someone is a serious threat to others, police intervention to take away their guns – not their knives, cars, chainsaws, flammable liquids, etc. – does nothing to prevent that dangerous person from committing a heinous crime. Police can never be sure that they’ve gotten all of an individuals guns, nor can they ensure that the person doesn’t have access to guns through other channels, and while guns are a popular tool for those bent on homicide, they are by no means the only tool that is readily available, nor the most effective. The worst mass murders in U.S. history did not involve guns as the primary weapon. The Happy Land murderer used a match and a dollar’s worth of gasoline to kill 87 people in 1990. Even one of the most often cited cases in support of these types of laws – the Isla Vista murders, in which a twisted little weasel killed 6 people in “retribution” for girls refusing to have sex with him (because he was a twisted little weasel) – half of the victims were stabbed to death, not shot. Taking the murderer’s guns away from him in advance of the rampage would probably have had little impact on the final outcome, and not necessarily a positive impact at that. On the other hand, taking the deranged little puke into custody and getting him some much needed mental health treatment might have saved all of those lives.

FOAC needs your support right now. Don’t put it off. If you live in Pennsylvania, Contact your State Representatives, your State Senators, your state Republican Party officials, and the Republican leadership in both houses, and demand that they stop this nonsense or face consequences in November. Giving Democrats what they want is not a way to win Republican elections!

The Nation is Watching Washington

The two firearm initiatives on the Washington ballot this year will have serious impact on other states.

Bloomberg and his cronies are already working on similar initiatives in other states. While many have bought into the polling numbers and think this is an unwinnable fight, we’re not ready to give up. We’ve seen GunVoters do the impossible in the past, and we believe they can do it again. If you are in Washington State, you’re on the front lines of the fight for rights. I-594 is a dangerous and misleading initiative. Beg people you know to vote against it, and be sure that you and your family don’t miss your opportunity to make a difference. Especially be sure that everyone in your household knows how bad this initiative is.  don’t find out later that your vote was nullified because your wife thought I-594 seemed reasonable.

If you don’t live in Washington, do you know people who do?  contact them and urge them to vote NO on I-594.  The stakes are high for all of us.

Reciprocity Problems in PA

PA Reciprocity Problems

 
Our friends in Pennsylvania need our help.
 
Their Attorney General has taken it upon herself to ignore the statutory limits on her power and modify – and even cancel – longstanding reciprocity agreements with other states.  Recently she has made changes to the reciprocity agreements with Virginia, Florida, and Arizona, and she has canceled reciprocity agreements with Idaho and Utah.
 
I suspect that Mike Bloomberg or the Legal Center Against Violence – or whatever those rights-hating San Francisco lawyers are calling themselves this week – have been whispering in the AG’s ear and convinced her that she can get away with this BS.  If that’s the case, be on the lookout for similar actions in other states.
 
Right now, we need to put pressure on Pennsylvania politicians to rein in the AG and force her to respect the rights of Pennsylvanians and folks who would like to visit that state.
 
If you are a PA resident, please contact your state legislators demanding that they get their Attorney General under control.
 
Whether you’re a PA resident or not, please let the Governor know that you’re not happy about the situation.  Not only does this mean that those of us wishing to visit PA are more likely to have problems carrying our personal defense arms, but Pennsylvanians wishing to visit other states are now at greater risk.
 
Tourism is a major industry in Pennsylvania and that got a boost a few years ago when the National Park Service ban on lawful carry on NPS lands was lifted – opening up battlefield parks like Gettysburg to those of us who avoid going where we can’t go armed.  That is now being jeopardized by the extra-statutory actions of this rogue AG.
 
If you’ve ever considered visiting Pennsylvania, let the Governor know that those plans are on hold until such time as the PA AG stops threatening the rights of responsible, licensed, law-abiding visitors.

Here is the note I’ve sent him.  Please use it as a guide to send him a note of your own to let him know that his AG is costing his state business. You don’t have to say a lot, just let him know you’re not happy and you’re going to avoid 
 
Dear Governor Corbett:
 
I’m very disappointed to learn that your Attorney General, Kathleen Kane, has chosen to exceed her statutory authority and modify or delete reciprocity agreements concerning the discreet carry of personal defense firearms.  My home state of Arizona and the state of Utah, where I have maintained a non-resident permit for a number of years, have been targeted.
While it is possible that I personally could legally carry my firearm in Pennsylvania – as I have been lawfully and responsibly doing for over three decades all over this country, I will not lend my support and tourist dollars to a state that is actively trying to infringe on my, and my fellow citizens’ rights.
I guess I’ll take my grandson to visit the Manassas and Fredericksburg, Virginia battlefields instead of Gettysburg this summer.  I’m also letting my friends know about this situation and encouraging them to suspend any planned visits to PA and to avoid doing business with PA-based businesses until this situation is resolved.
I hope you and the legislature will act quickly to bring this rogue politician into compliance with PA statutes and demonstrate that Pennsylvania still respects individual rights.  
Please let me know when your state is again open for business and tourism.

Primary season has already started.  Primary dates vary in each state, but it is a great opportunity for you to have an impact because so few people vote in the primaries.  Inexplicably, the NRA does not make endorsements in contested primaries – denying pro-rights candidates their support, and often leaving voters with a choice between two anti-rights candidates in November.

* UN Gun Control Treaty Passed by General Assembly
* Vote on Gun Control Package Imminent – Senators are “Home” this week.  Tell them how to vote!
On Friday, the Knox Gun Rights Report on World Net Daily (WND.com) alerted activists that the US Senate is scheduled to vote on the Democrat gun control package as soon as they return from their Easter Break.  Right now Senators are supposed to be in their home states meeting with constituents during this “State Work Period,” and some of them might actually be doing that.  If yours are among them, you could have the opportunity to tell them directly how you feel about their efforts to further infringe on your rights.

And then take action by telling your senators that none of the proposals are acceptable, that none of them would have prevented or mitigated the tragedies in Connecticut and Colorado, that none of them would reduce crime.  Tell them that a vote for any of them will be recognized as a betrayal of the Constitution and their oath of office.
Don’t delay!  Call, write, and call again! 
Some senators are under the mistaken notion that if they vote against gun and magazine bans they can freely vote in favor of expanded background checks (criminalizing private transfers) and “anti trafficking” proposals that would put gun owners and dealers at increased risk of federal prosecution.  You can correct these misperceptions.  
The votes should take place early next week.  Now is the time to push the message home: No New Gun Laws!  No Bans.  No “Universal Background Checks.”  No Dangerous New “Anti-Trafficking” laws.  No Compromise!

Over the weekend we alerted readers of the potential for the UN to move forward with a final vote adopting the sweeping Arms Trade Treaty that US negotiators have been blocking for years.
On Tuesday morning our fears were realized as the treaty was adopted in the UN General Assembly – with strong US support.  While the current language is much better than past versions, there are aspects of this treaty that have direct impact on US consumers and gun owners.

National Reciprocity Passes House

National Reciprocity Passes House

Today the US House of Representatives passed H.R.822, the National Concealed Carry Reciprocity Act of 2011. The bill passed by a vote of 272 to 154 with 43 Democrats voting for passage and 7 Republicans voting against it. There were also 7 members who were not present or abstained from the vote.

The bill now faces the US Senate and if it can be heard, voted on, and passes there, it would have to get past President Obama before it would become law. Nothing about those necessary steps looks promising at this point. Senate Majority Leader Harry Reid (D-NV) is the first hurdle. If Reid does not want the bill heard in the Senate, it will not be heard. Some parliamentary tricks could be used to “slip” the bill in somewhere, but only if Reid chooses to allow such a thing. A similar piece of legislation failed in the Senate a couple of years ago and little has happened to suggest the Millionaires Club would reach a different conclusion this year.

All in all, we feel the good of the bill outweighs the potential problems that might come with it so we encourage our readers to pressure the Senate to bring the bill to a vote. While you’re talking to your Senators, we also urge you to push them to support the Veterans’ Second Amendment Protection Act.

The comment period has been extended for the ATF’s proposed “temporary,” emergency regulation requiring firearms dealers to file reports every time someone purchases more than one semi-auto long gun, but that comment period closes this Tuesday, February 15.

The ATF claims the reporting is necessary to combat the flow of firearms across the border into Mexico, but recent revelations and accusations raise significant questions about ATF’s motives and the efficacy of such a reporting requirement.

In what has been dubbed “Project Gunwalker” ATF is accused of allowing hundreds of AR and AK- type rifles to be sold in questionable sales and smuggled across the border – including two rifles recovered after a shootout with bandits on the border in which Border Patrol Agent Brian Terry was killed.

The implications of the Project Gunwalker scandal are that ATF has already been receiving significant, voluntary cooperation from gun dealers in the border states, but that the agency has used that cooperation more to build support for their Project Gunrunner interdiction program and justify the need for the emergency reporting regulation by inflating the numbers of illegally “trafficked” weapons tracked across the border.

Beyond the complications of Project Gunwalker, the idea of requiring reporting of multiple long gun sales is clearly in conflict with established congressional mandates and restrictions on ATF’s authority.

Back in 1968 when the federal Gun Control Act was passed Congress included a requirement that multiple sales of handguns be reported to ATF and local law enforcement.  At that time, and several times since, Congress has had the opportunity to include multiple sales of long guns in the reporting requirements and they have chosen not to do so.  Congress has also passed several resolutions and included language in laws restricting ATF and other government agencies from instituting any sort of registration program or collecting detailed information from firearms sales without a direct connection to a specific criminal investigation.  By attempting to push through this major regulatory change without congressional approval, ATF is seriously overstepping their legal authority.

Subject: Oppose Regulation Expanding Multiple Sale Reporting

I am writing to oppose the so called emergency regulation to register multiple sales of certain rifles with BATFE as described in FR Doc. 2010-31761 from the 12/17/2010 Federal Register.  http://edocket.access.gpo.gov/2010/pdf/2010-31761.pdf
This regulation is both illegal and unnecessary.  Further there is no justification for any “emergency” implementation as reported by the Washington Post:

*  The regulation proposed is outside the statutory grant of authority to record information about multiple sales of firearms.  Title 18 U.S.C. § 923(g)(3)(A) specifically grants the authority to collect multiple sale information on handguns and revolvers.  Other firearms are excluded and there is no implied authority to extend this reporting requirement to rifles or any other type of firearm.
*  “FFL” holders are already required by law to respond to BATFE requests for information on firearms distribution pursuant to criminal investigations:  Title 18 U.S.C. § 923(g)(7).
*  The regulation contains no provision for the destruction of information collected, which establishes a nationwide registry of “certain types of firearms” as proposed. Because of this the regulation as proposed is illegal under Title 18 U.S.C. § 926(a).  “No such rule or regulation . may require that records required to be maintained under this chapter or any portion of the contents of such records, be recorded at or transferred to a facility owned, managed, or controlled by the United States or any State or any political subdivision thereof, nor that any system of registration of firearms, firearms owners, or firearms transactions or disposition be established.”
There is a grave potential for this regulation to unduly burden citizens who are collectors or must obtain purchase permits at the local or state level to possess firearms. The proposed regulation does not say what the agency intends to do with the information but ostensibly it would be for criminal investigations. Subjecting law abiding gun owners to this type of investigation under the guise of “information collection” is an overt attempt to prevent them from exercising their 2nd Amendment rights to purchase and own firearms.
*  This regulatory action has not allowed the public sufficient time to comment.
This regulatory action should not be approved.

Almost Final Push Against Holder!

Holder Hearings Thursday and Friday; Call Call Call!

    The Senate Judiciary Committee hearings on Holder's confirmation are Thursday and Friday, the 15th and 16th.  Opposition to Holder’s confirmation continues to grow and we need it to reach a crescendo Right Now.  The Firearms Coalition has received confirmation from Gun Owners of America that they have sent out an alert urging their members to get involved and they are actively seeking to testify at the hearing.  Alan Gottlieb of the Second Amendment Foundation and the Citizens Committee for the Right to Keep and Bear Arms has also spoken out against Holder’s confirmation.  The Heritage Foundation has illuminated some additional skeletons in Mr. Holder’s closet and numerous grassroots Second Amendment, privacy rights, and other liberty focused organizations have joined in the call for Barack Obama to withdraw Holder’s name from consideration or for the Senate to reject the nomination.

   Beginning Monday we need to flood the Senate Judiciary Committee members with calls and e-mails.  We want to generate a wave of objection which hits the committee members before the hearing so here is what we’re asking you to do:

ACTION  ITEM:

   1. Whether you have already done so or not, write e-mail messages to every member of the Senate Judiciary Committee and to your two senators and send those messages at least once Every Day from now until the hearing on Thursday.  It can be the same or a different message each day, that doesn't really matter, but be sure to make your position clear in the "Subject" line; something like "No Holder," "Reject Holder," or "Oppose Holder" should be in the subject line of every e-mail because it is likely to be all that the staffer stuck on e-mail duty will read before jotting a hash-mark in the "Opposed" column of a tally-sheet and moving to the next message.  Messages themselves should be short and clear, something like: “Dear Senator, Reject the nomination of Eric Holder for Attorney General.  He has demonstrated a serious lack of understanding of, and respect for the Constitution of the US and is an exceedingly poor choice for the office.”

    2. Place phone calls to all of the committee members and your two senators on Tuesday during your lunch period.  If your time is limited, prioritize; call the Republicans on the committee first, then the Democrats, then your own two senators.  If you run out of time, you run out of time, but make as many calls as you can. (Set the alarm in your cell phone to remind you.  Go ahead set it now; I'll wait.)

    3. Copy this call to action and re-post it on every blog, forum, and bulletin board you can find.

    Senators use web forms rather than e-mail and writing to them is notnearly as easy as it should be, but it is notreally all that difficult either.  Some Senators make it even more difficult by blocking direct links into their web forms and not putting their contact information in a prominent place on their web site.  Please persevere and make sure that they get your message.

   While it is extremely unlikely that we can muster enough votes to block this appointment in a straight up or down vote, we should definitely be able to generate enough support to stage a long filibuster and draw attention to Mr. Holder’s shortcomings.  Once Holder’s record is before the public and his credibility put in question, it is likely that he will withdraw from consideration (at the quiet request of Mr. Obama) and another name will be offered.

2. Holder Confirmation Hearing scheduled for January 15!!

 

Congress is planning to hit the ground running in a few days.  The new Congress will be sworn in on January 6 and the Senate Judiciary Committee has set a date of January 15 for confirmation hearings on Barack Obama's pick for Attorney General, Eric Holder.  Gunowners need to be pushing members of the committee very hard to delay and block the confirmation.

The Democrat members of the Judiciary Committee are all sworn enemies to the Second Amendment and are unlikely to be swayed at all by any firearms related arguments, but might hesitate to confirm based on Holders participation in the pardons of 16 Puerto Rican terrorists and billionaire financier and arms merchant Marc Rich.  Any letters to Democrats should focus on those issues.

On the Republican side, Arlen Specter, the ranking Republican on the committee has never been a friend to gun rights, but he owes his reelection to NRA support and has expressed concern over the pardon issues.  Among the other Republicans, most are relatively reliable votes, but only Coburn has routinely taken a leadership role on Second Amendment matters.  All of them need to be pressed hard to do everything they can to block the appointment.
